Behoused is a founder member of the Private Property Sales Association. (www.ppsauk.org.uk). All members of the Private Property Sales Association agree to operate in accordance with the Associations’ Code of Conduct which is available on the Association’s site. The Code provides protection to the public who use Member’s websites to sell their property privately. It sets out minimum standards which all Members must meet.
Sellers
You agree to abide by these Terms and Conditions. The payment of the fee entitles you to advertise your property on the Behoused site; gives you access to the software to manage your listing and enables you to receive enquiries in response to your advert. We assume, and you, by agreeing to list your property on our site, confirm and accept that:
- You have commissioned a Home Improvement Pack, if you are legally obliged to have one, prior to seeking a listing on Behoused.
- You are the legal owner of the property with the right to sell and give Behoused permission to display your property details on their website.
- The details supplied by you are true, fair, accurate, appropriately worded and not misleading.
- Any description submitted is not subject to any copyright or copied directly from any Estate Agent’s advertising.
- The e-mail or other contact details that you have supplied are in working order.
- You are responsible for the erection of the For Sale board in an appropriate place and in a manner that does not cause offence or risk to any other person and in accordance with the local rules and regulations.
- You will amend your details to ‘Sold’ status on the website and fix the ‘Sold’ sign to the For Sale board as soon as contracts have been exchanged.
- You also agree to delist your details as soon as the sale has been concluded and take down the For Sale board.
- You accept that there is no guarantee that your property will be sold through the website.
- You indemnify Behoused from any claims against us or expenses incurred if these conditions are not met.
- You acknowledge that the property details will not be displayed until payment has been received by Behoused.
- Behoused has the right to withdraw your advert without any liability to you if these terms are not met.
Enquiries, Viewings and Your Obligations
You, the seller, are responsible for handling enquiries, making viewing appointments, showing your property to interested parties, all negotiations with the potential buyer and instructing a solicitor to act on your behalf in all legal matters relating to your property sale. If you have already engaged the services of an estate agent to act on your behalf you are responsible for ensuring he is aware that you have placed an advert on the Behoused site, you are also responsible for any agency fees that he might subsequently charge under the agreement that you have with him.
Fees
These are charged on the basis of a single property. Advertising a property consisting of more than one dwelling is treated as a special case with fees on application.
Listing
The property will be listed as soon as the details and the payment have been received.
Listing Period
The fees paid are for displaying the property advert for 3 months. If a sale has not been arranged within this time the advert will be extended free of charge until such time as the property is sold or taken off the market.
Contact Details
We will use the contact details you supply to inform you of new services and products that might be on interest to you unless you specifically opt out when you register. Only those details you wish to be made available are published with your property details. Please refer to our Privacy Policy.
For Sale Board
The double-sided board is a standard size and make. You are responsible for obtaining a suitable post or other fixings for display purposes. Also supplied will be a ‘Sold’ label to attach to the board when you have accepted an offer. There are rules and regulations concerning Agency boards, set down in the Town and Country Planning (Control of Advertisements) Regulations 1992 – a copy of the relevant schedule is available from the following web site: http://www.hmso.gov.uk/si/si1992/Uksi_19920666_en_9.htm#sdiv3. The pertinent points are:
- Not more than one such advertisement, consisting of a single board or two joined boards, is permitted.
- Where more than one such advertisement is displayed, the first to be displayed shall be taken to be the one permitted.
- Any such advertisement shall be removed within 14 days after the sale is completed or a tenancy is granted.
- Where the advertisement is displayed on a building, the maximum projection permitted from the face of the building is 1 metre.
- Illumination is not permitted.
- No part of the advertisement may be higher above ground level than 4.6 metres, or 3.6 metres in an area of special control or, in the case of a sale or letting of part only of a building, the lowest level of that part of the building on which display is reasonably practicable.
You will be responsible for complying with these regulations and any others relevant to your particular area put in place by the Local Authority. If you have an existing agency agreement and the agent has already erected a board, it is up to you to discuss with the agent the removal of his board so that you can erect the Behoused board.
Payment
When using the online payment facility, as opposed to paying by cheque, our system does not record any details about your credit or debit card. These details are encrypted and only used and processed by HSBC, our external card processors.
Refund and Cancellation policy
Once the details of a house have been submitted and payment received, those details will be automatically published to the web site. No refund or cancellation of this listing can therefore be made for any reason as our service is deemed to have been delivered at the point of publication.
Behoused’s Liability to the Seller
Our maximum liability is limited to the fees paid
Buyers
We are not agents; we only offer the facility of this web site in order to display house advertisements. We have no input or control over what owners have said about their properties. You must employ your own judgement and experts to evaluate a particular offering.
Fees
There are none for the buyer.
Behoused’s Liability to the Buyer
We have none, apart from the wish that you will be happy with the service you receive through our site and that you find your new home from those on display. We hope that you will be so impressed that you use us when you come to sell your property.
Complaints Procedure
If a user of the Behoused website feels that they have a valid complaint about the level of service that they have received they should in the first instance email Complaints@Behoused.co.uk. Behoused will acknowledge receipt of the complaint within 5 days and hopefully resolve the complaint to the satisfaction of all parties within 4 weeks.
